2012년도 유엔 여성폭력 특별보고관의 연례 보고서의 주제는 여성에 대한 젠더 살해 (Gender related killings of women) 였습니다. 다음 내용은 당시 여성 폭력 특별보고관이었던 라시다 만주의 보고서 (A/HRC/20/16) 내용의 일부를 발췌한 내용입니다. 시간이 많이 지났지만, 여전한 현실입니다.

“여성살해(femicide)”라는 용어는 여성에게 불평등하고 억압적인 현실과 여성에 대한 구조적 폭력을 간과하게 하는 젠더 중립적인 용어인 살해(homicide)를 대체하기 위해 제안되었다. 이 용어는 1970년대 페미니스트 운동 투쟁에 재등장하여 페미니스트 스스로의 경험을 명명하고 이러한 치명적인 형태의 폭력에 대항하도록 했다. 초기에는 “증오, 경멸, 쾌락 또는 여성에 대한 소유 의식으로 인한 남성에 의한 여성의 살해”로 정의되다가 남성에 의한 여성에 대한 혐오살해(misogynist killings)를 넘어서, 성차별적 살해의 모든 형태로 확장되었다. 이 모든 성차별적 형태의 살해란 여성에 대한 우월감, 쾌락, 가학적 욕망, 또는 여성 소유를 상정 하는 등 사회적으로 구성된 권리에 동기를 부여 받은 남성에 의한 살해를 포함한다.

전세계적으로, 다양한 젠더 살해의 발현은 매우 심각한 규모로, 문화적 및 사회적으로 깊숙이 자리잡은 채, 적절한 처벌 없이, 용인되거나 혹은 정당화되고 있다. 여성살해에 관하여, 여성권리의 증진과 보호를 위한 많은 주의를 요하는 행위에 대한 국가의 책임은 크게 부족한 실정이다.

이 보고서가 나온지 4년이 지난 이번 32차 유엔인권이사회에서 신임 여성폭력특별보고관은 여성에 대한 살해를 감시하는 기구, 이른바 페미사이드 와치(femicide watch)를 설립할 것을 요청하 여성살해를 예방하는 차원에서 희생자의 나이, 민족, 가해자의 성별, 가해자와 피해자의 관계 등을 세부적으로 분류한 통계 수치를 발간하고, 가해자에 대한 기소와 처벌에 대한 정보를 수집할 것을 회원국들에 요청했습니다.

이에 코쿤과 한국여성단체연합이 공동으로 최근 강남역 여성살해사건에 비춰 여성 폭력의 문제를 정신장애인 차별의 문제로 치환하려는 시도와 대책을 비판하는 공동구두발언문을 발표하였습니다.

Thank you Mr. President,

The Korea Center for United Nations Human Rights Policy and Korean Women’s Associations United welcome the report of the Special rapporteur on violence against women, its causes and consequences (A/HRC/32/42) and particularly noted the establishment of a“Femicide Watch”, which compliments national protective systems, proper danger assessment, and quantitative and qualitative data for the prevention of femicide. We believe the new report will be helpful in holding states accountable for condoning socially and culturally widespread misogyny and gender related killings.

On May 17, a woman was brutally killed by an unknown man inside a unisex toilet in a main commercial district (Gangnam) in Seoul, Republic of Korea. The perpetrator, aged in his 30s, stated during the police investigation that he killed the woman because women have always looked down on him. Growing numbers of women are calling on the authorities to make changes to the society, in which misogyny and violence against women remain pervasive and tolerated.

However, the police and authorities concluded that the case is not a misogynist crime but rather a random killing by a person with 'mental illness', and announced a set of preventive measures, which includes the identification

and isolation of people in the early stages of mental illness. Ignoring the fact that structural discrimination and violence against women are deeply rooted in society, the government has not only attempted to distort the nature of the incident, but also done so in a way that promotes hate and discrimination towards another group of social minorities, namely persons with psychosocial disabilities. Also of deep concern is the exclusive focus of the preventive measures on strengthening punishment, such as through ‘maximum sentencing for gender-based crimes’ and ‘strengthening parole review for gender related crimes’. An overarching problem is the absence of a legal definition of violence against women. Also problematic is a lack of reliable and holistic data to analyze all forms of violence against women. Still, we find hope in the many people, including young students and office workers, showing strong solidarity in the fight against violence against women instead of remaining in fear and horror.

We would like to ask Madame Special Rapporteur:

● What kind of indicators must be included in national statistics with regards to gender based killings?

● Could the mandate holder and OHCHR provide technical assistance in developing a capacity building programs on gender and human rights for law enforcement officials, including the police, the judiciary and prosecutors, and in establishing a monitoring and assessment system? Are there any good practices?

And we would like to recommend the Republic of Korea:

● To immediately legislate a comprehensive anti-discrimination act to regulate hate crimes and discrimination against minorities;

● To abolish the ‘conditional suspension of indictment upon completion of counseling’, which has been abused by perpetrators of domestic violence;

● To introduce systematic regulations against the act of stalking to punish perpetrators and protect victims; and

● To amend relevant laws to ensure timely legal intervention of hidden camera blackmailing and the punishment of online mediums of dissemination.

본 공동발언문은 28개 단체의 입장을 대변하는 것입니다.

의장님,

한국여성단체연합과 유엔인권정책센터는 이번 여성폭력 특별보고관의 보고서(A/HRC/32/42)를 환영하며, 특히 국가적 보호제도, 적절한 위험 평가, 그리고 양적 및 질적 데이터를 보완하여 여성 살해를 막기 위한 “페미사이드 와치(femicide watch)” 설립을 요청한 것에 주목합니다. 특별보고관의 이번 보고서는 사회적 문화적으로 깊숙이 자리 잡은 여성혐오와 그에 따른 여성 살해를 용인해 온 국가에 그 책임을 물을 수 있는 계기를 마련해 주었습니다.

지난 5월 17일 새벽 1시, 서울의 한 번화가(강남) 건물 남녀 공용화장실에서 일면식도 없는 남성에 의해 한 여성이 무참히 살해당했습니다. 경찰조사에서 가해자인 30대 남성은 ‘여성들이 나를 무시했다’고 진술했으며 이후 여성들은 한국사회에 만연한 여성혐오와 폭력을 용인하는 한국사회의 변화를 촉구하고 있습니다. 특히 젊은 대학생과 직장인들이 중심이 되어 더 이상 두려움과 공포에 머물지 않고 연대하여 힘을 내겠다고 하는 의지와 행동을 보여주고 있다는 점에서 희망적입니다. 한편 경찰과 정부는 ‘여성혐오 범죄가 아니라 정신장애인(조현병)에 의한 묻지마 범죄’로 규정하며 정신질환자를 조기 발견하여 격리하겠다는 대책을 발표했습니다. 이는 여성에 대한 구조적 차별과 폭력을 무시한 채, 또 다른 사회적 소수자인 정신장애인에 대한 차별과 혐오를 조장하여 사건의 본질을 덮겠다는 행위에 불과합니다. 나아가 처벌 강화 중심으로만 대책을 제시하고 있는 점 역시 우려하지 않을 수 없습니다.

대한민국에는 ‘여성에 대한 폭력’에 대해 공식적으로 정의된 바 없으며, 모든 형태의 여성폭력을 통합적으로 보기는 어렵습니다.

그래서 여성폭력 특별보고관께 질의합니다. 
● 여성 살해에 관한 국가 통계를 구축하기 위해 필수적으로 조사해야 하는 항목은 무엇인지요? 
● 경찰 및 검찰, 판사 등 사법 공무원에 대한 젠더 및 인권교육을 실시함에 있어서, 교육 개발과 선정, 실행, 관리감독 및 평가 등에 대해 특별보고관께서 OHCHR과 함께 기술적 지원(technical assistance)을 계획해주실 수 있는지요? 아울러 효과적인 프로그램을 시행하고 있는 국가의 사례를 공유해주시길 요청합니다.

또한 다음과 같이 대한민국 정부에 권고합니다. 
● 다양한 사회적 소수자들에 대한 혐오와 차별을 규제ㆍ개선할 수 있도록 포괄적인 차별금지법을 신속히 제정할 것 
● 가정폭력 범죄 가해자에게 상담을 조건으로 면죄부를 주는 ‘상담조건부 기소유예’제도를 폐지할 것 
● 스토킹 전반에 대한 체계적인 규제, 스토킹 행위자 처벌, 피해자 보호 등을 규정하는 법률을 제정할 것
